1. Overview

This Privacy Policy describes how getpitchfork LLC ("Pitchfork," "we," or "us") collects, uses, discloses, and protects your information when you use getpitchfork.co and the Pitchfork platform ("Service").

2. Information We Collect

a. Information you provide

Account details (name, email, password), profile information (bio, social links, portfolio), content you upload (photos, videos, voice recordings, pitch materials), deal and contract information, payment details (processed by Stripe; we do not store full card numbers), identity-verification data (processed by Stripe Identity), and communications with us or other Users.

b. Information collected automatically

Device and browser information, IP address, pages visited and actions taken on the Service, referring URLs, and cookies and similar technologies (see Section 7).

c. Information from third parties

Authentication data from social login providers (Google, etc.), payment confirmation from Stripe, and identity-verification results from Stripe Identity.

3. How We Use Your Information

We use the information we collect to:

• Provide, maintain, and improve the Service
• Process transactions, including deal payments and platform fees
• Generate AI-powered features (pitch scripts, video generation, VisualIQ™ scoring, creator-brand matching)
• Facilitate identity verification and trust features (Verified badges)
• Communicate with you about your account, deals, and Service updates
• Enforce our Terms of Service and prevent fraud
• Screen every image upload, and sampled frames of every video upload, before they are saved or shown
• Comply with legal obligations and respond to lawful requests

5. How We Share Information

We do not sell your personal information. We share information only in these circumstances:

• With other Users:Profile information and content you choose to make visible on the marketplace. Personal contact information is shared only when you explicitly enable "Allow Direct Contact" in your settings.
• Service providers: We use third-party processors to operate the Service, including Stripe (payment card and checkout details), Stripe Identity (government ID and selfie), Amazon Rekognition (screens every image upload and sampled frames of every video upload before they are saved or shown; also screens the source image at generation for content labels and a face check; analyzes profile photos when VisualIQ is on; and compares an ID selfie with a profile photo for face matching), Anthropic (text you submit for AI writing, and scripts screened before generation), Cloudinary (images and videos you upload, including watermarked video), Supabase (account, profile, and content records), Vercel (hosts the Service), and Resend (account and transaction email, including the recipient address and message). These providers access data only as needed to perform services on our behalf and are bound by contractual obligations.
• Legal requirements: We may disclose information when required by law, regulation, legal process, or governmental request, or to protect the rights, safety, or property of Pitchfork, our Users, or the public.
• Business transfers: In connection with a merger, acquisition, or sale of assets, your information may be transferred as part of that transaction. We will notify you before your information becomes subject to a different privacy policy.

6. Data Retention

We retain your information for as long as your account is active or as needed to provide the Service. Deal records and licensing agreements are retained for a minimum of seven (7) years to support legal compliance and dispute resolution. When you delete your account, we remove your personal information within 90 days, except where retention is required by law or for legitimate business purposes (e.g., completed deal records).

7. Cookies & Tracking Technologies

We use essential cookies to operate the Service (authentication, session management, security). We may also use analytics cookies to understand how the Service is used. You can control non-essential cookies through the cookie-preference banner displayed when you first visit the site, or through your browser settings. Disabling essential cookies may prevent the Service from functioning properly.

8. Data Security

We use commercially reasonable technical and organizational measures to protect your information, including encryption in transit (TLS) and at rest, access controls, and regular security reviews. No method of transmission or storage is 100% secure, and we cannot guarantee absolute security.

9. Your Rights & Choices

Depending on your location, you may have the following rights regarding your personal information:

• Access & portability: Request a copy of the personal data we hold about you.
• Correction: Request correction of inaccurate data.
• Deletion: Request deletion of your personal data, subject to legal retention requirements.
• Opt-out of sale:We do not sell personal information. If California law classifies any data sharing described above as a "sale," you may opt out by emailing privacy@getpitchfork.co.

To exercise these rights, email privacy@getpitchfork.co. We will respond within 45 days as required by applicable law. We will not discriminate against you for exercising your privacy rights.

California residents (CCPA/CPRA): You have the right to know what personal information we collect and how it is used, to request deletion, and to opt out of any "sale" or "sharing" of personal information. Contact us as described above to make a request.

10. Children's Privacy

The Service is not directed to individuals under 18. We do not knowingly collect personal information from children. If we learn we have collected information from a child under 18 in the ordinary course of an account, we will delete it promptly, except where the law requires us to preserve it. We have zero tolerance for child sexual abuse material and any sexualized content involving minors. That content is blocked, the account is suspended, evidence is preserved, and it is reported to NCMEC's CyberTipline as required by US law (18 U.S.C. 2258A). 11. United States only

Pitchfork is offered to users in the United States only. Accounts are available to people who live in the United States. We do not offer the Service to residents of other countries. Information we collect is processed in the United States.

12. Changes to This Policy

We may update this Privacy Policy from time to time. We will notify you of material changes by posting a notice on the Service or emailing you at least 30 days before the changes take effect. The "Last Updated" date at the top of this page reflects the most recent revision.
